On April 6th, 2016, President and CEO of Focal Point Research had the honor to speak at Society of Cosmetic Chemists (SCC) Conference in Toronto, Canada. This presentation discussed two new and important pieces of legislation that have been recently introduced to the United States regarding the Federal regulation of cosmetics. These bills are not yet passed but are competing bills that would grant the U.S. Food and Drug Administration much more oversight of cosmetics.
These new pieces of regulation are known as the Sessions bill which was introduced by U.S. Congressman Pete Sessions and the Feinstein-Collins bill which was introduced by Senators Diane Feinstein and Susan Collins. The Sessions bill is known as The Safe Cosmetics Modernization Act. This bill is being currently supported by the Independent Cosmetic Manufacturers and Distributors (ICMAD) and it will “modernize and improve the FDA’s ability to assure the safety of cosmetics…requiring that all manufacturers be registered with the FDA”. Therefore, its goal was to improve the transparency within the industry.
The Feinstein-Collins bill is also known as the Personal Care Products Safety Act and would require the FDA to investigate five potentially risky ingredients every year. This bill is being currently supported by the Personal Care Products Council (PCPC) and would “require the FDA to review chemicals used…and provide clearer guidance on their safety.” Both pieces of legislation are very important for cosmetic companies to be aware of as, if passed; they would dramatically affect the ever-changing cosmetic industry.
